57 – The Laws of Paying Wages / Chapter Ten

E. If the employer told the worker to collect his payment from a certain person, and that person agreed to pay, and the worker, as well, agreed to the arrangement — then if in the end that other person did not pay, the employer does not transgress bal talin(“Do not withhold…”).

F. However, all this is only with regard to the prohibition of bal talin, but with regard to the employer’s fundamental obligation to pay his worker, the worker can change his mind about the arrangement and demand his pay directly from the employer. He may withdraw from this arrangement not only when the other person is refusing to pay, but even if that other person is still prepared to pay, the worker may nevertheless withdraw from the arrangement and demand his payment from the employer.

G. If, however, the worker freed the employer and explicitly declared that in any event he will not return to the employer to ask for payment — even if that third person will fail to pay him, or if the worker and employer made a formal kinyan(act of agreement) to the effect that the payment will come from that other person — then the worker may no longer retract his agreement and demand payment from the employer.
