The Laws of Stealing and Robbery (11)

1)    One who finds fruit in the street underneath a tree which hangs over the street, if they are a type of fruit which will usually fall from the tree and become unfit for eating by their fall or if the majority of the passers-by are not Jewish, or there are animals around who would normally eat these fruit, the owners will have given up hope of using these fruit and it is permitted for anyone to eat them. However, if this is not the case, it is forbidden to eat from these fruit because it is like stealing. (Kitzur Shulchan Aruch 182)

2)    Even in those cases where we have stated that it is permitted to eat from these fruit, this is only if the tree belongs to an adult. However, if the tree belongs to a child (e.g. to an orphan who has inherited his father) it is forbidden to eat them in any event as giving up hope and pardon of a minor has no effect at all. (ibid)
