The Laws of Stealing and Robbery (3)

1)    It is a positive commandment that a thief or robber must return the stolen object if it is still in existence in the same state as it was when he stole it and has not changed. In this case he has not fulfilled his obligation by returning only money to the value of the object even if the owners have completely give up hope of ever receiving it back. (Kitzur Shulchan Aruch 182)

2)    However, if the thief has lost the object or it has undergone a permanent irreversible change, or he has built it into a building and he will sustain a substantial financial loss by extracting it from there, then he can fulfil his obligation by paying money to the value that the object had at the time of the theft. (ibid)
