Laws of Lashon Hara / 3: 5-6 (39)

5. It is forbidden to speak lashon hara in a deceptive way – to make so to speak an innocent comment that is, in fact, intended as negative and according to the circumstances does in fact show negatively on someone.

6. One who speaks lashon hara, but his words do not in fact cause harm to the subject Example: the listeners did not take his words seriously], he has still transgressed the law of lashon hara. Even when one assumes beforehand that no harm will come to the subject, it is forbidden.

 

“Who is the man who desires life… guard your tongue from evil, and your lips from speaking deceitfully” (Tehillim 34:13-14)
