Chapter 17

Principles of the Laws Relating to the Transfer of Objects from One Place to Another

 

LAWS OF EIRUV CHATZEIROTH AND SHITUFEI MEVO’OTH (TRANSFERS INVOLVING PROPERTY OWNED IN COMMON)

11.a. It is permissible to transfer an object between two adjacent reshuyoth ha-yachid, if both have the same owners or, where the premises are rented, the same tenants.*

11.b. 1) Subject to the contents of paragraph 12 below, it is forbidden to transfer an object from one reshuth ha-yachid to another which is not in the identical ownership or tenancy, unless an eiruv chatzeiroth is made in accordance with the procedure outlined in paragraphs 13 to 17 below.

2) The prohibition includes

a) taking an object out of an apartment and putting it on the landing of the staircase which is owned in common, or which belongs to the landlord of the whole building,

b) bringing an object into an apartment from such a staircase, or from a similarly owned entrance hall,

or

c) a transfer from one room to another in the same apartment, where they are separately and exclusively rented by different individuals, even if the rooms are adjacent to each other and are owned by the same landlord.

11.c. 1) It is likewise forbidden, where there is no eiruu chatzeiroth, to transfer an object from one apartment to another through a staircase or courtyard owned or used in common by the occupiers of all the apartments.

2) This is so even if

a) the courtyard is surrounded by walls on all four sides and

b) both apartments are in the same ownership or tenancy.

* In the case of rented houses or apartments, the determining factor, for the purpose of the rules contained in this and the following paragraphs, is the identity of the tenant-occupiers, and not of the owners, unless the owners retain some right of use.
