LAWS OF EIRUV CHATZEIROTH AND SHITUFEI MEVO’OTH (TRANSFERS INVOLVING PROPERTY OWNED IN COMMON)
14.a. 1) An eiruv chatzeiroth can be effective to permit the transfer of objects, for example, from a house to a common courtyard in front of it.
2) This is because the right to use the courtyard belongs in common to the owners and occupiers of all the properties within the eiruv, to the exclusion of other persons.
14.b. 1) An eiruv chatzeiroth cannot be effective to permit the transfer of objects from a house or from a common courtyard to the street outside.
2) This is because the right to use the street is shared with other persons, who do not own or occupy properties included within the eiruv.
3) It makes no difference that the street in question fits, or has been converted to fit, the definition of a reshuth ha-yachid.
14.c. The transfer of objects to the street can only be rendered permissible by means of shitufei mevo’oth, as explained in paragraph 19 below.
