Laws Relating to the Erection of Protective Shelters and of Partitions on Shabbath and Yom Tov
TEMPORARY PROTECTIVE SHELTERS
5.a. The Rabbinical prohibition against erecting a temporary protective shelter applies
1) even if one intends to take it down that same day and
2) even if one puts up merely a covering, as where
a) the walls were put up before Shabbath or Yom Tov or
b) there are no walls and one simply spreads a mat or blanket over poles.
5.b. 1) It follows that it is, in general, forbidden to spread any kind of canopy, whether hard or soft, as a protection against
a) the sun,
b) the rain or
c) mosquitoes, flies and so forth.
2) It is likewise forbidden to make a tent out of blankets and the like, with the object of using the space underneath, whether one does so
a) on a balcony,
b) in a garden or yard or
c) even indoors.
3) It goes without saying that it is forbidden to erect an actual tent, notwithstanding that one intends to dismantle it the same day. (See also paragraph 16 below.)
