Chapter 27
Laws Relating to Animals on Shabbath and Yom Tov
CATCHING ANIMALS
41. If a bull escapes from its pen and runs wild, or if one fears it will run wild, one may return it to its pen, since leaving it loose involves a danger to human life.
42.a. If a wild bird such as a sparrow flies into the house, one ought not to trap it by closing the window.
42.b. Should one wish to close the window to protect oneself from the cold, one should, if possible, drive the bird out of the house first.
42.c. 1) Where there is no such possibility, one may, nonetheless, close the window.
2) This is because one does not intend to trap the bird, and it is in fact not confined in a space so constricted that it can easily be caught. (See paragraph 33 above.)
