A Miscellany: Remuneration (685)

Chapter 28

A Miscellany Including Stationery, Clocks, Noises, Baby Carriages, Remuneration and Advance Preparations

REMUNERATION FOR SERVICES RENDERED ON SHABBATH OR YOM TOV

66.a. There is a difference of opinion among the authorities as to whether the prohibition against receiving remuneration for work done on Shabbath applies also when the performance of the work is a mitzvah.

66.b. Examples occur where a person is engaged as a cantor on Shabbath or Yom Tov or to sound the shofar on Rosh Hashana.

66.c. Even those authorities who adopt the lenient view do not dispute the assertion, based on a Talmudic source, that, in general, a person does not profit from a reward he accepts for fulfilling these functions.

66.d. Bearing in mind the conflicting views on the subject, it is as well, where payment is made, to arrange for the remuneration also to cover

1) at least one service conducted by the cantor on day other than Shabbath or

2) the sounding of the shofar during the month preceding Rosh Hashana (Elul).

66.e. See also paragraph 61 above.

67. A doctor or a nurse who is called upon to give medical attention on Shabbath may request a fee for that attention, but the matter should not be mentioned on Shabbath.

68. If a person has transgressed the rules set out in the preceding paragraphs and has accepted remuneration for services rendered on Shabbath or Yom Tov, neither he nor anyone else may at any time derive any benefit from such remuneration.
