Laws of Lashon Hara / 3: 3-4 (38)

3. Lashon hara is forbidden not only when one’s intention is to condemn another or out of one’s hatred for another, but even when said in jest.

4. One who speaks lashon hara by only implying to someone, without mentioning a name, if the listener can identify who he’s referring to, it is forbidden.

Even when the story is not derogatory in and of itself, but it was a cause of one’s shame or disgrace, if that is the speaker’s intention, it is forbidden.

“Who is the man who desires life… guard your tongue from evil, and your lips from speaking deceitfully” (Tehillim 34:13-14)
