Non-Jew: General Rules (742)

Chapter 30

General Rules Relating to Actions Performed by a Non-Jew on Shabbath and Yom Tov

APPLICABLE PROHIBITIONS

3.a. 1) Although there are circumstances in which it is permissible to hint to a non-Jew that he should perform a forbidden activity on Shabbath or Yom Tov (as explained in paragraph 2 above),

2) there may still be a prohibition against deriving a benefit from that activity on Shabbath or Yom Tov

3.b. Indeed, even if a non-Jew of his own accord performs a forbidden act for a Jew on Shabbath or Yom Tov, it may be prohibited for a Jew to derive from it anything other than an indirect or non-substantive benefit.

3.c. See paragraphs 35 to 61 below for further details on this subject, including information as to when a benefit is considered to be direct and substantive.

4.a. It follows that there are two prohibitions involved in the performance of forbidden activities by non-Jews on Shabbath or Yom Tov:

1) a prohibition against telling a non-Jew to perform a forbidden act on Shabbath or Yom Tov (even if no benefit is derived from the act by a Jew):

2) a prohibition against deriving a direct, substantive benefit from a forbidden act performed by a non- Jew on Shabbath or Yom Tov (even if the non-Jew has not been told by a Jew to perform the act on Shabbath or Yom Tov, but has performed it for a Jew of his own volition).

4.b. The rules relating to these prohibitions are elucidated by the examples in paragraphs 5 to 10 below.
