Laws Relating to the Erection of Protective Shelters and of Partitions on Shabbath and Yom Tov
PARTITIONS ERECTED FOR THEIR HALACHIC EFFECT
36. A partition fixed to the wall, such as a folding door, may be opened to its full extent,
a. even if it has not been open to the width of a tefach or more since before the start of Shabbath or Yom Tov and
b. even if the intention in opening it out is to serve a halachic purpose (as explained in paragraph 30 above).
36.a. One may request a non-Jew to erect a partition which is intended to serve a halachic purpose (as explained in paragraph 30 above), if
1) the partition is temporary and
2) one needs it in order to be able to fulfill a mitzva, for example to pray in a place free from the presence of excrement.
36.b. It must be remembered that a partition made in order to last for as little as a few days is considered to be permanent and not temporary. (See paragraph 26 above.)
