Chapter 17

Principles of the Laws Relating to the Transfer of Objects from One Place to Another

LAWS OF EIRUV CHATZEIROTH AND SHITUFEI MEVO’OTH (TRANSFERS INVOLVING PROPERTY OWNED IN COMMON)

17. Since the eiruv chatzeiroth operates on the basis that all of the owners and tenants have rights of ownership in the food partnership provided, none of them ought to raise any objection if one of the others wishes to exercise his rights by eating the food before Shabbath, or at its commencement, which is when the eiruv comes into effect.

18.a. One should make an eiruv chatzeiroth wherever appropriate, so as to limit the possibility of transgressing the prohibition against the transfer of objects.

18.b. It is important to consult a qualified rabbinical authority on the detailed application of the rules relating to eiruv chatzeiroth.
